Terms and Conditions

This Agreement contains the terms and conditions that apply to an individual's or entity's participation in the Sendapage4U Program (the "Program").

1) General Definitions:
As used in this Agreement, "we" and "our" means Sendapage4U.com and "you" means the applicant. 

2) Sendapage4U Program. 
We offer our send a page program FREE to valid websites. We will list the top websites using our SendaPage4U program on our categories and main site at our discretion. You will need to have at least 10 active Sendapage4u forms on your site. By joining our program we can add or remove your site from our categories at any time, depending on the holiday, theme, or choice of featured websites. 

3) Link Design 
We have created and will make available to you copy and artwork for Sendapage4U forms. These are free provided that such banners-created links do not misuse our trademarks and are not deceptive, misleading, or in violation of any third party's trademark, copyright, or other proprietary or personal rights. Both parties retain ownership of and all rights in their respective trademarks and service marks. 

4) Earn Money 
If you have 10 or more active pages using our system during the month, we include your advertisement rotation with ours across our network of sites. This will promote your site and bring you more traffic. 50/50 advertising.

5) Conditions of Participation:
a) You are not permitted to participate in our Sendapage4U Program if you send out unsolicited email. If you send out unsolicited email, we will discontinue service.

b) You are not permitted to participate in our Program--if the content of your site and/or email promotes hate, deals with illegal activities and/or violates the law or the rights of third parties.

c) You are not permitted to post references to our Program in newsgroups or Internet bulletin boards.

d) You are not permitted to participate in our Sendapage4U Program if your site contains or links to sites containing any sexual content.

e) You must maintain a valid email address with us;

f) We have the right to change the terms of our agreements with you at any time. Such changes will be posted on our site on the Web.

g) Your website must be in English! If we can't read it then we cannot accept your application.

h) Our computers instantly accept your application to participate in our Program without evaluating your compliance with our rules. Acceptance of your application does not mean that we approve of your participation. You will be contacted within 24 to 48 hours with a confirmation email and will be required to reply to it, to complete registration. We may disapprove your application or terminate it at any time. If you do not comply with this agreement, you are not permitted to join our Program.

7. Termination:
We have the right to terminate your participation in our Program at any time for any reason. You have the right to cancel your participation in our Program at any time for any reason. If you choose to not use our program please contact us or if there is no activity for 60 days we will contact you by email and if no reason known the account will be closed.

8. LIMITATIONS OF LIABILITY:

WE WILL NOT BE LIABLE FOR INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES (OR ANY LOSS OF REVENUE, PROFITS, OR DATA) ARISING IN CONNECTION WITH THIS AGREEMENT OR THE PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SENDAPAGE4U.COM SHALL HAVE NO RESPONSIBILITY FOR FAILURES DUE IN WHOLE OR IN PART TO ACTS OR OMISSIONS OF ADVERTISERS OR USERS OR DUE TO FAILURES OF OR DEFECTS IN THIRD PARTY HARDWARE, SOFTWARE OR COMMUNICATIONS SYSTEMS.

9. DISCLAIMER OF WARRANTIES

WE MAKE NO EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE PROGRAM, OUR WEB SITE, OR ANY OF THE PRODUCTS OFFERED BY US. IN ADDITION, WE MAKE NO REPRESENTATION THAT THE OPERATION OF OUR SITE WILL BE UNINTERRUPTED OR ERROR-FREE, AND WE WILL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS. SPECIFICALLY, ADVERTISER ACKNOWLEDGES AND UNDERSTANDS THAT THE INTERNET IS AN EVOLVING MEANS OF COMMUNICATION AND THAT SENDAPAGE4U.COM MAY ENCOUNTER TECHNICAL OR OTHER DIFFICULTIES BEYOND ITS CONTROL.


10) Assignment:
You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. 

11) No Waiver
Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

12)Any information that you post on this site will be treated as non-confidential and non-proprietary.  You are prohibited from posting or transmitting to or from this site any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material, or any other material that could give rise to any civil or criminal liability under the law.  If you do not agree to these terms, do not use this site.

12a)This site may contain links to other sites on the Internet that are owned and operated by third parties (“External Sites”).  You acknowledge that the Sendapage4u.com is not responsible for the availability of, or the content located on or through, any External Site.  You should contact the site administrator or Webmaster for those External Sites if you have any concerns regarding such links or the content located on such External Sites.

13)We have the right to change our form at anytime without prior notice.
